Terms of Service

Agreement

By creating an account or using GUS, you agree to be bound by these Terms of Service. If you don't agree with any part of these terms, please don't use the service.

You must be at least 13 years old to create an account and use GUS.

Your Account

• You are responsible for maintaining the security of your account and keeping your login credentials confidential.
• Don't share your password with anyone.
• You are responsible for all activity that occurs under your account, whether or not you authorized it.
• We may suspend or terminate accounts that violate these terms.

Your Content

You retain full ownership of everything you create in GUS -- your photos, journal entries (specimens), notes, routes, and all other user-generated content.

By using GUS, you grant us a limited license to store, display, and transmit your content solely for the purpose of providing the service to you. We do not claim any ownership rights over your content.

You can export and delete your content at any time through the app.

Acceptable Use

When using GUS, you agree not to:

• Use GUS for anything illegal or in violation of applicable laws.
• Upload harmful, abusive, or offensive content.
• Attempt to access other users' data or accounts.
• Interfere with the service's operation or infrastructure.
• Reverse-engineer, decompile, or attempt to extract the source code of GUS.

Cost Intelligence Data

Price data, cost indexes, and city intelligence within GUS are provided for informational purposes only. We make no guarantees about the accuracy, completeness, or timeliness of pricing data.

GUS is not a financial advisory service. Do not make financial decisions based solely on data provided by GUS.

Crowdsourced price data reflects user-reported values and may not reflect current market conditions.

Rarity Ratings

Rarity ratings (Common, Uncommon, Rare, Legendary) are subjective and user-assigned. They represent the user's personal assessment of a specimen, not an objective or standardized classification.

Service Availability

GUS is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free service.

We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify users of significant changes before they take effect.

Limitation of Liability

To the maximum extent permitted by law, GUS and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100 if you are on the free tier.

We are not liable for data loss. Please use the export feature to maintain regular backups of your content.

Intellectual Property

GUS, its design, code, and branding are owned by EPH Tech Solutions. The Westminster design system, operative class system, and Found Moment experience are proprietary.

Third-party libraries (Leaflet, Supabase, etc.) are used under their respective licenses. You can view a full list in the Licenses section within the app's Settings.

Changes to Terms

We may update these terms from time to time. When we do, we will post the revised version on this page with an updated date at the top.

Continued use of GUS after changes are posted constitutes your acceptance of the revised terms.

Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms or your use of GUS will be resolved through binding arbitration, unless prohibited by applicable law.
